Terms of sale and license

These terms are between you and Cool Mountain LLC (1600 Hancock Rd., Georgetown, IN 47122, an Indiana limited liability company), who make Go2Cue. By buying, renting or using Go2Cue you agree to them. Nothing here takes away rights you have by law where you live.

1. Who sells it

Our order process is run by our online reseller Paddle.com, who are the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply to the payment. These terms apply to the software and the license.

2. What a license is

• A license lets you run the Go2Cue stage manager's hub with the number of feeds, stations and Asst Stage Managers in its plan. Crew stations (computers, tablets and station boxes) are free and need no license.
• A license key runs on two computers at a time: the hub and a spare. You can move it from one computer to another on your account page or in the app.
• To own: you may use the versions released during your year of updates for as long as you like. After that year, those versions keep working; newer versions need an update renewal.
• To rent: you may use Go2Cue between the rental's start and end dates, plus one grace day. After that the hub moves to the free plan, at its next launch or after an hour with nothing on standby, never in the middle of a cue sequence.
• Education: a plan bought with an education discount is a license for one year, for teaching, learning and school productions at the school named in the request, not for hire or commercial work. To carry on, confirm again for a new discount. A rental bought with an education discount is an ordinary rental.
• The free plan and the 60-minute demo need no license.

3. What you may not do

• Share a license key beyond its two computers, or resell or sublicense it without our written agreement.
• Work around the license checks, or change the clock to stretch a rental.
• Reverse-engineer the software, except where the law allows it.

We may revoke a license that was refunded, charged back, or obtained or used against these terms. A revoked license moves the hub to the free plan.

4. Checks

When it has internet, the stage manager's hub asks our license service at launch and twice a day whether its license is still good. This sends the license key, the computer's id and the app version (see the privacy policy). Without internet, Go2Cue keeps working on the license it has.

5. Refunds

6. Not a safety system

Go2Cue runs over your network, which can fail. It is a cueing aid, not a safety system. Keep another way to reach your crew (a headset, a god mic, a runner). Do not use Go2Cue as the only means of stopping a moving or hazardous effect, or anywhere a failure could hurt someone.

7. Warranty

Go2Cue is provided "as is". To the extent the law allows, we make no warranty that it will be free of faults or suit a particular show, and we disclaim implied warranties of merchantability and fitness for a particular purpose.

8. Liability

To the extent the law allows, Cool Mountain LLC is not liable for indirect or consequential losses (such as a lost performance, lost ticket sales or lost data), and our total liability for any claim is limited to what you paid for the license in the twelve months before it.

9. Changes

We may update these terms. The version in force when you bought applies to that purchase; a change that takes away something you paid for does not apply to it.

10. Law

These terms are governed by the laws of Indiana, USA, without regard to conflict-of-law rules. Consumers keep the protections of the law where they live.
